TERMS OF SERVICE

§1.

Definitions

  1. Rules and Regulations - these course rules and regulations.

  2. The Organizer - the organizer of the course is Dariusz Zabrocki conducting business under the name "DAREK ZABROCKI" located in Gdansk, POLAND and Michał Kus conducting business under the name “KUS-ART” located in Den Helder, HOLLAND.

  3. Participant - a natural person taking part in the course.

  4. The Administrator - the personal data of the course Participants is administered by the Organizer. The privacy policy is § 9 of these Rules and Regulations.

  5. GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

§ 2.

General provisions

  1. The Organizer declares that he conducts courses covering particular specifications within the "Concept Art" field of movie and game design, called "Focal Point School", which is the first European school teaching "Concept Art", run by the Organizer.

  2. The Organizer realizes the course within the scope, dates and venue described in detail in the course offer available on the Organizer's website: www.focalpointschool.com

  3. The Organizer declares that he has the knowledge and experience enabling him to conduct the course in the scope described in section 1 of this paragraph.

§ 3.

Terms and conditions of participation

  1. In order to participate in the course, it is necessary to register by filling in the online registration form, which is available on the Organizer's website: www.focalpointschool.com, including acceptance of the provisions of these Rules and Regulations and payment in the amount of ... PLN.

  2. Payment for the course should be made to the Organizer's bank account indicated in the electronic correspondence confirming the registration, by filling in the online payment form which is available on the Organizer's website: www.focalpointschool.com, no later than 3 (three) working days after online registration, and no later than 5 (five) working days before the planned date of the course. The date of payment shall be the date on which the Organizer's bank account is credited. In case of transfers made during weekends, the Participant is additionally obliged to send confirmation of the transfer to the Organizer's e-mail address: info.focalpointschool@gmail.com, typing in the subject: "Payment for the course" along with the generated order number and the name of the course.

  3. The transfer title should include the generated order number and the name and surname of the Participant, as well as the course chosen by the Participant.

  4. If the full payment is not made within the time limit referred to in section 2 of this paragraph, the Participant shall be deemed to have resigned from the course and the application for participation shall be canceled as of the expiry of the abovementioned time limit.

  5. The full schedule of the course will be available for each Participant through the appropriate Facebook group, as well as via electronic correspondence in response to the Participant's inquiry regarding this subject.

§ 4.

Course

The course price includes:

  1. participation in a selected course with the participation of artists from the field of "Concept Art",

  2. training materials,

  3. a certificate of participation in the course.

§ 5.

Cancellation and change of venue of the course by the Organizer

  1. The Organizer reserves the right to cancel the course without giving a reason, in particular, in case of a lack of the required number of Participants or unforeseen random events or other events beyond the Organizer's control.

  2. In case of the cancellation of the course, all payments made for participation in the course will be returned to the bank accounts from which they were received within 30 working days from the date of cancellation of the course, unless the Organizer agrees another date of the course with the Participant.

  3. The Organizer reserves the right to change the venue of the course within the Tri-City (Gdańsk, Gdynia, Sopot), as well as the date of the course, no later than 30 days before the planned date of the course.

  4. Information about a change in the venue of the course, a change of date or its cancellation will be sent to the e-mail address given in the registration form or will be announced on the following website: www.focalpointschool.com or on the Facebook group's website or forwarded by the Organizer to the Participant by phone at the number provided in the online registration form.

§ 6.

Resignation from the course by the Participant

  1. The Participant has the right to resign from the course, together with the right to receive a refund of the entire payment for the course only if another Participant is indicated on the day of crediting the Organizer's bank account with the payment for the course made by the new Participant.

  2. In case of the resignation of the Participant without indicating another Participant, the Participant is entitled to a refund of the amount paid of:

    1. 100% in case of resignation within 30 days before the planned start of the course,

    2. 50% in case of resignation within 10 days before the planned start of the course,

    3. 0% in case of resignation within 9 days before the planned start of the course.

  3. Subject to sub-paragraph 1, in case of purchasing a course 10 days or less before the planned start of the course, the Participant is not entitled to a refund of the payment.

  4. Under pain of nullity, resignation from the course must be reported by the Participant to the Organizer's e-mail address: info.focalpointschool@gmail.com, typing in the subject: "Resignation from the course" along with the generated order number and the name of the course.  

§ 7.

Liability

The Organizer declares that the content provided by him during the course is of an educational nature only. The Organizer shall not be liable for any damage caused to the course Participants or third parties, in connection with or as a result of the use by the Participants in any way of the information, knowledge or skills acquired during the course, including in particular, in a manner inconsistent with their intended use.

  1. The Participant is responsible for any damage caused in the facility where the course takes place, including damage to the equipment or elements of the room equipment, etc., and in particular, is obliged to repair any damage, including by paying an appropriate sum of money determined by the injured party.

  2. The Organizer is not responsible for cash, documents and other items left by the Participants of the course at the venue where the course was conducted.

  3. The Organizer is not responsible for damage caused to the Participant by other Participants of the course.

  4. The Organizer's liability for all titles is limited to the amount of payment for the course to which the damage relates.

  5. The Organizer's liability for damage in the form of lost profits is excluded.

§ 8.

Complaints

  1. The Participant is entitled to lodge a complaint in connection with the course or the quality of the course. If the Participant is not a Consumer, the complaint can be made within 7 days of the date on which the course took place.

  2. Complaints may be submitted in writing to the Organizer's address or in electronic form via email to the address: info.focalpointschool@gmail.com, writing in the subject line: "Complaint", and in the description of the complaint: information and circumstances concerning the subject of the complaint, as well as the subject of the request and contact details of the complainant.

  3. The Organizer shall consider complaints promptly, in electronic or written form, not later than within 14 days of the date of receipt. If the complaint cannot be considered within this period, the Organizer shall notify the complainant in writing about the reasons for the delay and the expected date of processing the complaint.

§ 9.

Privacy policy

  1. In accordance with Article 13(1) of GDPR, we inform you that the personal data controller of the Participant is the Organizer.

  2. Personal data will be processed within the scope specified by the Participant by means of application forms and other forms of contact with the Organizer in order to provide services related to conducting training courses on the basis of art. 6 par. 1 lit. b GDPR (activities necessary to perform the contract to which the data subject is a party or to take action at the request of the data subject, before concluding the contract), to pursue possible against the Participant pursuant to Art. 6(1)(f) of GDPR (realization of the legitimate interests pursued by the controller) and, if additional consents are given pursuant to Article 6(1)(a) of GDPR, to the extent and for the purposes indicated in the content of those consents.

  3. The Participant's personal data may be disclosed to:
    a. public entities entitled on the basis of separate regulations, for the purposes of proceedings conducted by them,
    b. entities and persons cooperating with the Organizer in the scope of conducting the course,
    c. other external entities supporting the Organizer, in particular, in the scope of IT services, accounting, legal or cooperating with the Organizer within the framework of marketing campaigns, while such entities shall process data on the basis of an agreement with the Organizer and exclusively in accordance with the Organizer's instructions.

  4. The personal data of the Participant will be processed until the execution of the agreement and also after its completion for purposes related to:

    a. pursuing claims in connection with the performance of the contract (i.e. in principle for a maximum period of 10 years from the date of termination of the performance of the contract),

    b. the performance of obligations resulting from the provisions of law, including in particular tax and accounting obligations,

    c. data for marketing purposes:
    - in the case of data processing on the basis of consent, for the duration of marketing campaigns or until the consent is withdrawn,
    - in the case of data processing on the basis of the legitimate purpose of the Organizer, for the duration of marketing campaigns or until the moment of objection;

    d. if the Participant consents to the processing of personal data for other purposes, the Participant's personal data will be processed until the withdrawal of such consent.

  5. A Participant shall have the right of access to the content of his data and the right to the rectification, erasure, restriction of processing, the right to data portability, the right to object, and in the event of additional consent, the right to withdraw the consent at any time without prejudice to the lawfulness of any processing based on consent prior to its withdrawal.

  6. If the Participant considers that the processing of personal data violates the provisions of GDPR, the Participant has the right to lodge a complaint with the President of the Office for Personal Data Protection at ul. Stawki 2, 00-193 Warsaw.

  7. Providing the personal data included in the application form by the Participant is a condition for concluding the contract.

  8. The Participant's data will not be used for automated decision-making based solely on automated processing, including profiling, and producing legal effects on the Participant or significantly affecting the Participant in a similar manner.

§ 10.

Final Provisions

  1. The Participant of the course is not entitled to record images or sound during the course, unless (under pain of nullity) the Organizer gives prior written consent to the recording of images or sound.

  2. The Organizer is entitled to use the work done by the Participant(s) during the course by publicly presenting it and / or publishing it in the media, including press, internet, social media, portfolio, etc. and to place the organizer's logo on them.

  3. The Participant agrees to the issue of VAT invoices by the Organizer without the signature of the person authorized to receive VAT invoices.

  4. The Participant of the course provides the Organizer with personal data included in the application form by the Organizer for purposes related to the organization of the course.

  5. The Participant concluding the agreement declares that he or she has read the content of these Rules and Regulations and accepts its provisions.

  6. The Rules and Regulations are drawn up in Polish and English. In the event of any discrepancies as to their content or interpretation, the Polish version shall prevail.

  7. The Rules and Regulations are governed by Polish law, in particular in matters not regulated by the relevant provisions of Polish civil law.

  8. All disputes that may arise during the execution of the course are subject to the jurisdiction of Polish courts. The court competent to resolve them is the court with territorial jurisdiction over the registered office of Dariusz Zabrocki, the Organizer of the course.
